1. Acceptance of Terms
By accessing and using Fanset International's services, website, and software platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
These terms apply to all users of our services, including vehicle tracking systems, fleet management software, fuel monitoring solutions, and related telematics services.
If you do not agree to these terms, please refrain from using our services. We reserve the right to modify these terms at any time, and continued use of our services constitutes acceptance of any changes.
2. Description of Services
Fanset International provides vehicle tracking, fleet management, fuel monitoring, driver behaviour analysis, and related telematics services to businesses and organizations.
Our services include but are not limited to: GPS vehicle tracking, real-time fleet monitoring, fuel consumption analysis, driver safety scoring, maintenance scheduling, temperature monitoring for cold chain logistics, and comprehensive reporting dashboards.
Service availability may vary by region and is subject to network coverage, hardware compatibility, and subscription plan limitations.
3. User Obligations
Users must provide accurate and complete information when registering for our services and maintain the confidentiality of their account credentials.
You agree to use our services only for lawful purposes and in accordance with applicable laws and regulations, including but not limited to data protection, privacy, and employment laws.
Users are responsible for ensuring proper installation and maintenance of tracking devices and must not tamper with, modify, or attempt to circumvent any security features of our systems.
You must notify us immediately of any unauthorized use of your account or any security breach.
4. Data Collection and Usage
By using our services, you consent to the collection, processing, and storage of vehicle location data, driver behaviour metrics, fuel consumption data, and other operational information.
We process data in accordance with our Privacy Policy and applicable data protection regulations. Data is used to provide and improve our services, generate reports, and ensure system security.
You are responsible for complying with all applicable data protection laws regarding the personal data of drivers and employees collected through our services.
We implement industry-standard security measures to protect your data but cannot guarantee absolute security of data transmission over the internet.
5. Intellectual Property Rights
All intellectual property rights in our services, including software, algorithms, interfaces, documentation, and trademarks, remain the exclusive property of Fanset International.
You are granted a limited, non-exclusive, non-transferable license to use our services for your internal business purposes during the subscription period.
You may not copy, modify, distribute, sell, or lease any part of our services or software, nor may you reverse engineer or attempt to extract the source code.
6. Payment Terms
Subscription fees are billed in accordance with your service agreement and must be paid by the due date specified in your invoice.
Late payments may result in service suspension and may incur additional charges. We reserve the right to modify pricing with reasonable notice.
Hardware purchases, installation services, and additional features may be subject to separate pricing and terms.
Refunds are handled on a case-by-case basis and are subject to our refund policy as outlined in your service agreement.
7. Limitation of Liability
To the maximum extent permitted by law, Fanset International shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
We do not guarantee uninterrupted or error-free service and are not liable for any losses resulting from service interruptions, data inaccuracies, or system failures.
Our total liability for any claims arising from these terms or your use of our services shall not exceed the fees paid by you in the twelve months preceding the claim.
We are not responsible for decisions made based on data provided by our services, including but not limited to employment decisions, routing choices, or operational changes.
8. Termination
Either party may terminate services in accordance with the notice period specified in your service agreement, typically 30 days written notice.
We may suspend or terminate your access immediately if you breach these terms, engage in fraudulent activity, or fail to pay fees when due.
Upon termination, your access to our services will be revoked, and your data may be deleted after a retention period as specified in our data retention policy.
Termination does not relieve you of any obligations incurred prior to termination, including payment obligations.
9. Governing Law and Disputes
These terms are governed by the laws of the jurisdiction in which Fanset International operates, without regard to conflict of law principles.
Any disputes arising from these terms or your use of our services shall be resolved through negotiation in good faith. If negotiation fails, disputes may be submitted to binding arbitration.
You agree to waive any right to participate in class action lawsuits against Fanset International.
